The state of Hawaii has legalized medicinal marijuana but still not allows the citizens to use recreational marijuana.

Hawaii was the first state to legalize medical marijuana or weed in 2000 under the SB 862 became Act 228 through legislation.

The laws regarding cultivation, processing, and distribution were revised.

The change also required the registration of patients and caregivers.

The Department of Health was responsible for expanding the possession limit, setting up a licensing system for dispensaries, and chalk out qualifying conditions.

Even though the legalization bill was passed in 2000, the dispensaries were given licenses in 2018.

In 2019 Huawei decriminalized the possession of a small amount of weed in HB 1383.

The only penalty for possessing 3 grams or less cannabis was a fine of $130.

Processing up to an Ounce of marijuana carries a sentence of 30 days in jail and a fine of $1,000.

 Patients who are authorized to use medical weed or cannabis can buy from state-regulated dispensaries located in Ohau, Molokai, Maui, and Hawaii.

However, the patients and caregivers cannot possess more than four ounces or 113 grams of dried weed within 15 consecutive days or 8 ounces or 227 grams of right weed in 30 straight days.

Transportation of weed between island’s still remains illegal, and the carriers must conceal their weed while transporting it within the state. 

The state allows weed consumption in privately owned properties only.

Patients can not smoke or vape medical marijuana publicly.

 Registered patients and their caregivers can cultivate up to 10 healthy plants of weed on their private property.

All plants must be at the exact location and tagged with the Cannabis card number and its expiry date.

Medical marijuana/weed in Hawaii

 The patients who are suffering from qualifying conditions need to register with the medical Cannabis registry program.

In this way, they can receive their Huawei 329 card that will allow them to purchase a limited amount of weed from the state license to dispensaries.

Out of state patients can also apply for the Huawei 329 card; however, they need to get themselves checked by a physician in Hawaii to get the license.

Some qualifying conditions registered by the Hawaiian government are:

  • Amyotrophic lateral sclerosis 
  • Cancer
  • Cachexia, or wasting syndrome
  • Epilepsy
  • Glaucoma
  • HIV/AIDS
  • Lupus
  • Muscle spasms
  • Multiple sclerosis
  • Post-traumatic stress disorder (PTSD)
  • Rheumatoid Arthritis
  • Seizures
  • Severe nausea
  • Severe pain

 To apply for a 329 card, the patients must see a licensed physician and register for an online account.

For this process, the patients require their government-issued ID to prove their identity and Residency.

The patients need to pay a price of $38.50 for the one-year card and $77 for a two-year card only if they qualify for it.
